Bijou Phillips , 43, has filed for a divorce from Danny Masterson, 47.
This comes following the 30-year sentencing of the That 70s Show actor after being convicted for the ‘forcible rape’ of two women in 2003.
According to PEOPLE, Phillips filed for divorce on Monday in a Santa Barbara, California court and cited ‘irreconcilable differences’ as the reason for ending their marriage of nearly 12 years.
Their separation date was listed as ‘TBD’ and Phillips has requested that she receive spousal support, as well as asking to ‘terminate the court’s ability to grant support’ to Masterson.
The couple, who began dated in 2004, share one child together, a 9-year-old daughter named Fianna Francis.
Phillips has requested she get full legal and physical custody of their daughter, and that she and her former partner’s assets be divided up by the court as separate property.
Bijou’s lawyer confirmed the divorce filing in a statement, saying: “Her priority remains with [their child].”
It also said that Danny “was always present for [his wife] during her most difficult times” and “is a wonderful father”.
“She hopes that everyone will respect her family’s privacy in these difficult times.”
