The former CNN host, Lemon, was taken into custody by federal agents on Thursday night while he was in Los Angeles covering the Grammy’s.
He has been arrested after entering a Minnesota church and filming anti-immigration enforcement protesters.
His attorney said: “Don will fight these charges vigorously and thoroughly in court.
“Don has been a journalist for 30 years, and his constitutionally protected work in Minneapolis was no different than what he has always done.
“This unprecedented attack on the First Amendment and transparent attempt to distract attention from the many crises facing this administration will not stand.”
Lemon himself said in a recent video: “Once the protest started in the church, we did an act of journalism, which was report on it.”
Many are now questioning freedom within the USA.
Lemon’s former CNN colleague, Jim Acosta, wrote: “This is outrageous and cannot stand. The First Amendment is under attack in America.”
Sky US correspondent, James Matthews, said: “He has been a critic of Donald Trump and this does, of course, raise questions about fundamental freedoms in this country.
“His lawyer issued a statement calling this an unprecedented attack on the First Amendment and she’s saying that he will fight these charges vigorously.”
The White House responded with a post of their own about Lemon being arrested, writing: “When life gives you lemons…”
