When a promised twelve inches doesn’t measure up, would you head to court?
Last week an image went viral on the Internet. The snap, posted by an Australian Subway customer featured a one of the chains ‘footlong’ sandwiches and a measuring tape that proved that the meal had failed to live up to its name.
Now, two men from New Jersey have decided to go one further and sue the chain of sandwich shops, claimed that the have been repeatedly left short buy the fast-food merchants.
The suit was filed in New Jersey this week, and the lawyer for the plaintiffs says he is seeking class-action status, meaning many more claimants could get in on the action. The suit states that it is “deceptive practice for Subway to advertise its large sandwich as a ‘footlong.’”
The snap that started it all… this image went viral after it was posted to Subway’s Facebook page…
The plaintiffs estimate the discrepancy amounts to the customer being charged 45 to 60 cents extra per sandwich. The men are looking for compensatory damages and a change in Sudway’s practice that would see them ensure all ‘footlong’ sandwiches will indeed measure twelve inches in future.
In a statement released yesterday Subway said; “We have redoubled our efforts to ensure consistency and correct length in every sandwich we serve,”
“Our commitment remains steadfast to ensure that every Subway Footlong sandwich is 12 inches at each location worldwide.”
