Emile Hirsch reportedly checked into rehab following the incident which resulted in him being charged with aggravated assault.
The actor was charged after Paramount Pictures executive Daniele Bernfeld claimed that he put her in a chokehold during Sundance Film Festival.
Attorney Robert Offer told TMZ that Hirsch was intoxicated on the night in question and sought help following the alleged altercation.
He said: “Emile consumed an enormous amount of alcohol on the evening in question and he has no memory of what happened.
“Emile takes these allegations very seriously and is devastated that any of this has occurred.
“A few days after the incident, Emile sought help and checked himself into an alcohol rehabilitation facility, where he remains today, to ensure nothing like this ever happens again.”
According to reports this morning, he is due in court on March 16th and could face up to five years in prison, and a $5,000 fine, if convicted.
